Recently I received an email from the NRA-ILA with an article titled, "Federal Appellate Court Upholds Decision to Block California’s Magazine Surrender Requirement" In this article they discussed an appeal court upholding a lower courts blocking of a law that limits the capacity of gun magazines to 10 rounds or fewer. I contacted Greg Block and asked the question, "Does this mean that I can now carry a 12-17 round magazine in my pistol?" His response was not what I thought it would be. I expected an answer along the lines of, "Yes, you can carry bigger magazines", or, "Nope. Not until it has been reviewed AGAIN." Greg is an acknowledged expert witness in firearms cases and is someone that I trust.
Instead his response included the phrase, "It will be used against you criminally and civilly." He was reminding me of the message that I was discussing in yesterday's blog post about the messages that we, as gun owners, send. One of the best ways to help our lawyer defend us in a criminal or civil case is to conduct your life in a respectful, law-abiding manner. Do not give the District Attorney or opposing counsel ANYTHING that can be misconstrued. That is one of the ways that they win cases. They make you look guilty. Don't help them.
